Parties & Identification

Associate Broker

Judy Beltran, licensed Associate Broker under Utah Code Title 61, Chapter 2f, Real Estate Licensing and Practices Act, affiliated with Iron Mountain Realty LLC. Utah Division of Real Estate License on file.

Brokerage

Iron Mountain Realty LLC, a Utah limited liability company registered with the Utah Division of Real Estate and the Utah Division of Corporations and Commercial Code. Office: 16 N 900 W, Cedar City, UT 84720.

Principal Broker

Matthew Leeper, Principal Broker. The VOW and all brokerage services offered through the Platform are operated under the supervision and accountability of Matthew Leeper, as required by Utah Code § 61-2f-206(5) and the NAR Virtual Office Website Policy.

Technology Provider

Security Lion, a trade name (DBA) of Roy Leon LLC, a Utah limited liability company. Security Lion is the technology services provider responsible for the development, hosting, and maintenance of the Platform on behalf of Iron Mountain Realty LLC.

Platform

Precision Quotes Real Estate Tech, the branded web application and voice agent service operated by Judy Beltran, under the supervision and accountability of Principal Broker Matthew Leeper, through which Registrants may access MLS listing data and related real estate information.

Registrant / "You"

Any individual person who completes the registration process described in Section 4 and agrees to these Terms of Use for the purpose of accessing MLS listing data through the Platform.

Purpose & Nature of This Agreement

These Terms of Use establish a lawful broker-consumer relationship between You and Iron Mountain Realty LLC, through Associate Broker Judy Beltran acting under the supervision of Principal Broker Matthew Leeper, solely for the purpose of providing You with access to real estate listing data available through the Platform’s Virtual Office Website (“VOW”) and voice agent services.

Agency & Disclosure Statement

In accordance with Utah Administrative Code R162-2f-401a and the requirements of the NAR Virtual Office Website Policy, the following disclosures are made:

3.1 — Broker Identification & License Status

The Platform is operated by Judy Beltran, an associate broker holding an active license issued by the Utah Division of Real Estate, affiliated with Iron Mountain Realty LLC. Pursuant to the NAR Virtual Office Website Policy, Section I.1(b), this VOW is operated by a non-principal broker with the consent of the MLS Participant (Iron Mountain Realty LLC, through its Principal Broker) and is subject to Matthew Leeper’s oversight, supervision, and accountability. The Platform operates under the supervision of Principal Broker Matthew Leeper, as required by Utah Code § 61-2f-206(5) and § 61-2f-302. Judy Beltran and all licensees affiliated with Iron Mountain Realty LLC are subject to the regulatory authority of the Utah Real Estate Commission and the Utah Division of Real Estate under Utah Code Title 61, Chapter 2f.

3.2 — No Agency Relationship

Your registration and use of this Platform does not establish any agency relationship between You and Judy Beltran, Iron Mountain Realty LLC, Principal Broker Matthew Leeper, or any affiliated licensee. No fiduciary duties — including but not limited to loyalty, obedience, full disclosure, confidentiality, reasonable care and diligence, safekeeping of funds, or any additional contractual duties as described in Utah Administrative Code R162-2f-401a(1) — are owed to You as a result of this registration.

3.3 — Unrepresented Consumer Status

As a Registrant under these Terms of Use, You are an unrepresented consumer. You are not receiving brokerage representation services. The data and information made available to You through the Platform is provided for Your informational purposes only and does not constitute real estate advice, a recommendation, or a professional opinion regarding any specific property or transaction. You are encouraged to seek the advice of qualified professionals — including licensed real estate agents, inspectors, lenders, attorneys, tax advisors, and title agents — before making any real estate decisions.

3.4 — Transition to Representation

Should You wish to engage Judy Beltran or any licensee affiliated with Iron Mountain Realty LLC for brokerage representation services, including but not limited to property tours (in person or live virtual), offer preparation, negotiation, or transaction management, a separate written Buyer-Broker Agreement must be executed prior to the commencement of such services. Any such agreement will be between You and Iron Mountain Realty LLC, acting through its Principal Broker or a designated licensee. Pursuant to the practice changes required by the National Association of REALTORS® settlement effective August 17, 2024, a written buyer agreement is required before touring a home. That agreement will be presented to You separately and will contain, at minimum: a specific disclosure of the amount or rate of compensation; a term prohibiting the agent from receiving compensation exceeding the agreed amount; and a conspicuous statement that broker fees and commissions are not set by law and are fully negotiable.

Registration Requirements

Before accessing MLS listing data through the Platform, You must complete the following registration process:

1. Provide Your Legal Name. You must provide Your true and accurate full legal name.
2. Provide a Valid Email Address. You must provide a functioning email address to which You have regular access.
3. Email Verification. Upon registration, a confirmation email will be sent to the email address You provide. This email will confirm that You have agreed to these Terms of Use. You may access the Platform only after the email address has been verified and You have received the Terms of Use confirmation.
4. Establish Credentials. You must establish or be assigned a unique username and password combination. Your username and password combination must be different from those of all other Registrants. One email address may be associated with only one username and password.
5. Password Expiration. Your password will expire periodically in accordance with applicable MLS rules (not less frequently than every ninety (90) days). You may renew Your password at or before expiration to maintain access.
6. Voice Agent Registration. If You register through the voice agent interface operated by the Platform, the same registration requirements apply. Your verbal affirmation of identity, email address, and agreement to these Terms of Use will be recorded and confirmed via email. Voice-based registration is subject to the same legal effect as web-based registration under Utah Code § 46-4 (Uniform Electronic Transactions Act).

4.1 — Record Retention

Iron Mountain Realty LLC will maintain a record of Your name, email address, username, and current password for not less than one hundred eighty (180) days following the expiration of Your password. These records may be disclosed to the MLS upon request if the MLS has reason to believe that a breach in data security or a violation of MLS rules has occurred.

Registrant Acknowledgments

By accepting these Terms of Use, You affirmatively acknowledge and agree to the following:

1. Lawful Broker-Consumer Relationship. You acknowledge that You are entering into a lawful consumer-broker relationship with Iron Mountain Realty LLC, through Associate Broker Judy Beltran acting under the supervision of Principal Broker Matthew Leeper, for the limited purpose of accessing real estate listing data through this Platform.
2. Personal, Non-Commercial Use. All data and information obtained by You from this Platform is intended only for Your personal, non-commercial use.
3. Bona Fide Interest. You represent that You have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through this Platform.
4. No Redistribution. You will not copy, redistribute, retransmit, or otherwise disseminate any of the data or information provided through this Platform, except in connection with Your personal consideration of the purchase or sale of an individual property.
5. MLS Copyright. You acknowledge that the multiple listing service (“MLS”) that supplies listing data to this Platform owns and holds a valid copyright in the MLS database. Unauthorized reproduction, distribution, or use of MLS data is a violation of federal copyright law.
6. MLS Compliance Access. You expressly authorize the MLS, and other MLS participants or their duly authorized representatives, to access the Platform for the purposes of verifying compliance with MLS rules and monitoring the display of participants’ listings.

Data Accuracy, Disclaimers & Limitations

6.1 — Data Reliability

The listing data displayed on this Platform is supplied by the MLS and is deemed reliable but is not guaranteed accurate by the MLS, by Iron Mountain Realty LLC, by Principal Broker Matthew Leeper, by Judy Beltran, or by Security Lion. All data is subject to errors, omissions, changes in price, prior sale, or withdrawal without notice. You should independently verify any information before relying on it for any purpose.

6.2 — Listing Attribution

Each listing displayed on this Platform will identify the name of the listing firm and the name of the listing agent in a readily visible, reasonably prominent location and typeface.

6.3 — Data Refresh

MLS listing data displayed on this Platform is refreshed not less frequently than every three (3) days.

6.4 — No Brokerage Advice

The Platform provides data and information for Your review. Nothing on this Platform — including but not limited to listing information, market data, estimated values, maps, neighborhood information, or any output generated by the voice agent — constitutes brokerage advice, a professional opinion, a recommendation to purchase or sell any specific property, or a substitute for the professional judgment of a licensed real estate agent, attorney, inspector, appraiser, lender, or other qualified professional.

6.5 — Limitation of Liability

To the maximum extent permitted by applicable law, Iron Mountain Realty LLC, Principal Broker Matthew Leeper, Judy Beltran, Security Lion, and their respective officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to Your use of this Platform, the data or information provided herein, any errors or omissions in such data, or any action taken or not taken in reliance on such data.

6.6 — Technology Disclaimer

The voice agent and web-based search features of this Platform are powered by artificial intelligence and automated systems provided by Security Lion. Automated outputs may contain inaccuracies. You acknowledge that interactions with the voice agent do not constitute a conversation with a licensed real estate professional unless Judy Beltran or a licensee affiliated with Iron Mountain Realty LLC expressly identifies themselves as such during the interaction.

Prohibited Uses

You agree that You will not use the Platform or any data or information obtained from the Platform for any of the following purposes:

1. Any commercial or business purpose, including but not limited to aggregating, compiling, or redistributing listing data for resale, marketing, advertising, or solicitation.
2. Scraping, data mining, automated querying, or any other method of systematic extraction of data from the Platform.
3. Providing data obtained from the Platform to any third party for any purpose other than in connection with Your personal consideration of the purchase, sale, or lease of an individual property.
4. Accessing or attempting to access the Platform using another Registrant’s credentials.
5. Circumventing, disabling, or interfering with any security, authentication, or access-control features of the Platform.
6. Using the Platform or voice agent in any manner that violates applicable local, state, or federal law or regulation.

Privacy Policy

Iron Mountain Realty LLC and Security Lion are committed to protecting Your privacy. The following describes how information obtained from You through this Platform will be collected, used, and safeguarded:

8.1 — Information Collected

We collect: Your name, email address, username, and password as provided during registration; records of Your search activity on the Platform (including search criteria, properties viewed, and saved searches); and, if You interact with the voice agent, transcripts or recordings of such interactions. If You voluntarily provide additional information (such as property preferences, location, budget, or contact details), that information will also be collected.

8.2 — SMS & Text Message Data

If You opt in to receive SMS text messages from Iron Mountain Realty, we collect the following additional information:

1. Phone number provided by You for the purpose of receiving text messages.
2. Consent records, including the date, time, IP address, and method by which You provided express written consent to receive text messages (e.g., web form checkbox, keyword opt-in via text).
3. Message logs, including the content, date, and time of text messages sent to and received from Your phone number, and delivery status.
4. Opt-out records, including the date and time You revoked consent by replying STOP or through other means.

This SMS-related data is used solely for the following purposes: sending You the text messages You consented to receive (appointment reminders, property alerts, and follow-up communications); maintaining records of consent as required by the Telephone Consumer Protection Act (TCPA) and carrier regulations; and complying with opt-out requests. Your phone number and SMS data will not be sold, rented, or shared with third parties for their marketing purposes. SMS data may be shared only with: our SMS service provider (Twilio) solely to deliver messages on our behalf, and as required by law or legal process.

8.3 — Use of Information

Your information will be used to: provide You with access to MLS listing data and Platform features; communicate with You regarding Your account, including password expiration and Terms of Use updates; respond to Your inquiries about properties displayed on the Platform; send You text messages if You have opted in to our SMS program (see Section 8.2 and Section 16); comply with MLS rules and applicable law, including furnishing registration records to the MLS upon lawful request; and improve the functionality and performance of the Platform.

8.4 — Disclosure of Information

Your information may be disclosed to: the MLS, as required by MLS rules (including Your name, email address, username, password, and activity audit trail if the MLS has reason to believe a security breach or rule violation has occurred); Judy Beltran and licensees affiliated with Iron Mountain Realty LLC, for the purpose of responding to Your property inquiries; Security Lion, solely in its capacity as the technology provider operating the Platform; our SMS service provider (Twilio), solely for the purpose of delivering text messages You have consented to receive; and as required by law, regulation, or legal process. Your personal information, including Your phone number, will not be sold to or shared with third parties for marketing or advertising purposes.

8.5 — Data Security

We employ reasonable security measures to protect Your information from unauthorized access, use, or disclosure. No system can guarantee absolute security, and You acknowledge that You provide information at Your own risk.

8.6 — No Sale of Personal Information

Iron Mountain Realty LLC and Security Lion will not sell, rent, or lease Your personal information to third parties for marketing or commercial purposes unrelated to the services described in these Terms of Use.

Electronic Transactions & Consent

This agreement is entered into electronically in accordance with the Utah Uniform Electronic Transactions Act, Utah Code Title 46, Chapter 4.

1. You consent to conduct this transaction electronically. Your affirmative click of the “I Agree” button, or Your verbal affirmation of agreement through the voice agent, constitutes Your electronic signature and is legally equivalent to a handwritten signature under Utah Code § 46-4.
2. You acknowledge that You have been provided the opportunity to review these Terms of Use in their entirety before expressing Your agreement.
3. You acknowledge that You may retain a copy of these Terms of Use by printing this page, saving it as a PDF, or requesting a copy be sent to the email address You provide during registration.
4. You agree that electronic records of Your registration, Your agreement to these Terms, and Your activity on the Platform satisfy any requirement that such records be in writing.

Intellectual Property

The MLS database and all listing data provided through this Platform are the copyrighted property of the applicable MLS. “Precision Quotes Real Estate Tech” is a branded product of Iron Mountain Realty LLC. The Platform’s design, software, voice agent technology, and non-MLS content are the property of Security Lion and/or Iron Mountain Realty LLC, as applicable. All rights not expressly granted to You under these Terms of Use are reserved.

Judy Beltran, or another licensee affiliated with Iron Mountain Realty LLC under the supervision of Principal Broker Matthew Leeper, will be willing and able to respond knowledgeably to inquiries from Registrants about properties within the market area served by Iron Mountain Realty LLC and displayed on this Platform.

Termination & Modification

12.1 — Termination by You

You may terminate this agreement at any time by discontinuing Your use of the Platform. You may request deletion of Your registration by contacting Iron Mountain Realty LLC using the contact information provided in Section 11. Termination does not affect the record retention obligations described in Section 4.1.

12.2 — Termination by Iron Mountain Realty LLC

Iron Mountain Realty LLC may suspend or terminate Your access to the Platform at any time, with or without cause, including but not limited to violation of these Terms of Use, suspected misuse of MLS data, or direction from the MLS.

12.3 — Modification

Iron Mountain Realty LLC reserves the right to modify these Terms of Use at any time. Material changes will be communicated to You via the email address on file. Your continued use of the Platform after notification of changes constitutes acceptance of the modified Terms. If You do not agree to the modified Terms, You must discontinue use of the Platform.

Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms of Use shall be resolved in the state or federal courts located in the State of Utah, and You consent to the personal jurisdiction of such courts.

Severability

If any provision of these Terms of Use is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect the validity or enforceability of the remaining provisions.

Entire Agreement

These Terms of Use constitute the entire agreement between You and Iron Mountain Realty LLC with respect to the subject matter hereof — namely, Your registration for and use of the Platform for the purpose of accessing MLS listing data. This agreement supersedes all prior or contemporaneous communications, whether electronic, oral, or written, with respect to such subject matter. For the avoidance of doubt, this agreement does not supersede, replace, or modify any separate Buyer-Broker Agreement, listing agreement, purchase agreement, or other written agreement that may be entered into between You and Iron Mountain Realty LLC or any affiliated licensee.

SMS Terms of Service

16.1 — Program Name & Description

Iron Mountain Realty SMS Alerts is a text messaging program operated by Iron Mountain Realty LLC, through Associate Broker Judy Beltran, that delivers appointment reminders, property alerts, and follow-up communications to consumers who have provided express written consent to receive such messages.

16.2 — Consent & Opt-In

By checking the SMS opt-in checkbox on any lead form on this Platform, or by texting the keyword SUBSCRIBE to our business number, You are providing Your express written consent to receive recurring automated text messages from Iron Mountain Realty at the phone number You provide. Consent is not a condition of any purchase or service. You may opt in through:

1. Checking the SMS consent checkbox when creating an account or submitting a lead form on this website.
2. Texting SUBSCRIBE to (801) 919-5253.
3. Providing verbal consent during a phone or voice agent interaction (recorded and confirmed via text).

16.3 — Message Frequency & Content

Message frequency varies based on Your interaction with our services. You may receive messages related to: appointment reminders and confirmations; new property listings matching Your preferences; follow-up communications regarding Your real estate inquiry; and responses to Your questions or requests. You will not receive more than 10 messages per week unless You initiate a conversation.

16.4 — Message & Data Rates

Message and data rates may apply. Your mobile carrier’s standard messaging and data rates apply to all text messages sent and received through this program. Iron Mountain Realty is not responsible for any charges imposed by Your carrier.

Your phone number and SMS data are handled in accordance with our Privacy Policy (Section 8). Your phone number and personal information will not be sold, rented, or shared with third parties for marketing purposes. For full details on what SMS data we collect and how it is used, see Section 8.2.

16.8 — Carriers & Liability

Carriers are not liable for delayed or undelivered messages. Iron Mountain Realty is not responsible for messages that are not received due to carrier issues, device incompatibility, or changes to Your phone number.
